Overview

This website is run by OurComic, Jenny Tanghestraat 6 bus 302, 9050 Gent, Belgium, VAT BE 1013.024.646 ("OurComic", "we", "us", "our"). We offer this website, our script web app and all related information, tools and services (the "Service") to you on the condition that you accept these terms of service, together with the policies they refer to, such as our refund policy, shipping policy and privacy policy (together, the "Terms").

By visiting our website or buying from us, you agree to these Terms. They apply to everyone who uses the website, including visitors and customers. If you do not agree, please do not use the Service. New features and tools are also covered by these Terms. You can always read the latest version on this page.

Our store runs on Shopify, which provides the e-commerce platform that lets us sell to you.

Nothing in these Terms limits the rights you have as a consumer under mandatory law.

1. Our product and how an order works

We make one product: a personalised comic page of 9 panels, drawn from your story, printed on museum-quality paper and framed in a solid wood frame of 30 × 40 cm (black or oak). Prices include VAT and shipping. We make your comic with our own software, which uses AI. Someone on our team works out every panel and has every panel that isn't right redone before you get the preview.

• You tell us your story and characters on the product page, add photos if you like, and pay. Your order is a binding contract once we confirm it by email.
• Within 24 hours you get a link to your script. You edit the text, dialogue and characters yourself in our web app, as often as you like, at no extra cost. Until you approve your script, you can cancel for a full refund.
• If you don't approve or reply, your script is approved automatically 3 days after we send it.
• After script approval we draw your 9 panels within 2 working days and send you a preview. 2 changes to the drawing are included. The drawing is approved automatically 5 days after we send the preview if we don't hear from you.
• We print and ship within 1 working day of drawing approval. Delivery times are in our shipping policy.

After script approval your comic is made to order. The 14-day right of withdrawal does not apply to personalised goods. Our refund policy explains what this means and what we do if your comic arrives damaged or misprinted.

2. Your story, photos and content

You keep the rights to the story, texts and photos you give us. You give us permission to use them to create, print and deliver your comic and to help you with your order.

You confirm that you have the right to share this content, including photos and details of other people, and that it does not infringe anyone's rights (such as copyright, privacy or portrait rights) or break the law. We may refuse or cancel an order, with a full refund, if the content is unlawful, hateful, obscene, defamatory or otherwise inappropriate.

We may show the drawn comic as an example on our website and social media. We never show the photos you sent us, and only first names. Rather not? Let us know after approving your comic or email contact@our-comic.com; we then won't show it or will take it down.

3. Using our website

By agreeing to these Terms, you confirm that you are of legal age in your country of residence, or that you have that age and have given permission for a minor in your care to use this website.

You may not use our products or Service for any illegal or unauthorised purpose, or break any law (including copyright law) while using the Service. You must not send worms, viruses or any other harmful code. If you break these Terms, we may end your use of the Service immediately.

4. General conditions

We may refuse service to anyone for a valid reason. Your content (not including card details) may be sent unencrypted over various networks and adapted to the technical requirements of networks or devices. Card details are always encrypted in transit.

You may not copy, reproduce, sell, resell or exploit any part of the Service, or access to it, without our written permission. Headings in these Terms are for convenience only.

5. Accuracy of information

We do our best to keep the information on our website accurate and up to date, but it is general information. We may change the content of our website at any time, but we have no duty to update it.

6. Changes to the Service and prices

We may change our prices and change or stop the Service (or any part of it) at any time. The price you pay is the price shown when you placed your order. To the extent permitted by law, we are not liable to you or anyone else for any change, price change, suspension or ending of the Service.

7. Colours and images

We show the colours and images of our product as accurately as we can, but we cannot guarantee that your screen shows every colour exactly. Each comic is drawn for you, so it will look different from the examples on our website. Your characters are a drawn interpretation of your description and photos, not an exact likeness. Want something different? That's what the 2 included drawing changes are for.

We may limit sales to certain people, regions or countries, and may stop offering the product at any time. Any offer is void where prohibited.

8. Orders, billing and account information

We may refuse or cancel an order, for example when we suspect fraud or when an order appears to be placed by a reseller. If we change or cancel your order, we will contact you using the email address or phone number you gave us, and refund you in full for anything we cannot deliver.

You agree to give us current, complete and accurate order and account information, and to update it promptly (including your email address and payment details) so we can complete your order and contact you.

9. Third-party tools and links

We may give you access to tools from third parties that we do not monitor or control. We provide them "as is" and "as available", without warranties of any kind. Your use of them is at your own risk, and you should check the terms of the provider.

Links to third-party websites are for your convenience. We are not responsible for their content, products, services or practices. Please read their policies before you buy anything from them. Complaints about third-party products should go to the third party.

10. Comments, feedback and other submissions

If you send us ideas, suggestions, reviews or other comments ("comments"), you agree that we may edit, copy, publish, translate and otherwise use them in any medium, without obligation to keep them confidential, pay for them or respond to them. This does not apply to your story and photos for your order, which are covered in section 2.

We may remove content that we find unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms. Your comments must not infringe the rights of others, or contain unlawful, abusive or obscene material or malware. You may not use a false email address, pretend to be someone else or mislead us about the origin of your comments. You are responsible for your own comments.

11. Personal data

How we handle the personal data you give us is described in our privacy policy.

12. Errors, inaccuracies and omissions

Our website may sometimes contain typing errors, inaccuracies or omissions, for example in product descriptions, prices, promotions, shipping costs, delivery times or availability. We may correct them, and change or update information, at any time. If a clear error affects your order, we may cancel it and refund you in full.

13. Prohibited uses

You may not use the website or its content: (a) for any unlawful purpose; (b) to ask others to take part in unlawful acts; (c) to break any international, national or local law or regulation; (d) to infringe our intellectual property or that of others; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate against anyone on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to give false or misleading information; (g) to upload or send viruses or other harmful code; (h) to collect or track other people's personal data; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or get around the security features of the Service or any related website. We may end your use of the Service if you do any of these things.

14. Warranties and liability

We do not guarantee that the Service will always be available, uninterrupted, timely, secure or error-free. We may take the Service offline for a while or stop it at any time.

Except as we expressly state and to the extent permitted by law, the Service is provided "as is" and "as available", without further warranties or conditions of any kind. This does not affect your statutory rights, including the legal guarantee on products that do not conform to the order.

To the extent permitted by law, OurComic, its directors, employees, agents, suppliers and service providers are not liable for indirect, incidental, special or consequential damages, such as lost profits, lost revenue, lost savings or loss of data, arising from your use of the Service or any product bought through it. Our liability is in all cases limited to the amount you paid for the order concerned. These limits do not apply to liability for death or personal injury caused by our negligence, for fraud or intent, or to any liability that cannot be limited by law.

15. Indemnification

You agree to indemnify and hold harmless OurComic and its directors, employees, agents, suppliers and service providers against any claim or demand by a third party, including reasonable legal costs, arising from your breach of these Terms, your violation of any law or your infringement of the rights of a third party (for example through content you give us).

16. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it will still apply as far as the law allows, and the rest of these Terms remain valid and enforceable.

17. Termination

Obligations and liabilities that arose before termination survive it. These Terms apply until you or we end them. You can end them at any time by telling us you no longer want to use the Service, or by no longer using our website. If you break these Terms, we may end them at any time and refuse you access to the Service. You remain liable for any amounts due up to that date.

18. Entire agreement

If we do not enforce a right or provision of these Terms, that does not mean we waive it. These Terms and any policies or rules we publish on this website form the entire agreement between you and us about the Service, and replace any earlier agreements, communications and proposals, including earlier versions of these Terms. Any ambiguity in these Terms will not be interpreted against the party that drafted them.

19. Governing law

These Terms and any separate agreements under which we provide the Service are governed by Belgian law. If you are a consumer living in another country, you keep the protection of the mandatory rules of the law of that country.

20. Changes to these Terms

You can always read the latest version of these Terms on this page. We may update, change or replace parts of these Terms by publishing the changes on our website. Changes do not apply to orders you placed before the change. If you keep using the website after a change, you accept the new Terms.
